MANDATORY LEAD-BASED PAINT INSPECTIONS OF ALL RENTAL SINGLE-FAMILY, TWO-FAMILY, AND MULTIPLE-DWELLING UNITS THAT WERE CONSTRUCTED BEFORE 1978

On July 22, 2021, Governor Murphy signed P.L. 2021, c. 182 which requires periodic lead-based paint inspections for certain dwellings constructed prior to 1978 for the purpose of identifying lead-based paint hazards.

Effective immediately, upon tenant turnover or within two years of the effective date of the law, dwelling owner’s and landlord’s subject to the provisions of this rule must provide the Division with a copy of a valid lead-safe certificate.

Owners are permitted to directly hire a lead evaluation contractor to perform these periodic inspections; however, a valid lead-safe certification must be issued by the lead evaluation contractor and a copy of the certification must be provided to the Division.

Failure to comply can result in a fine of up to $1,000.00 per week until the inspection has been conducted or until remediation efforts have begun. These inspections are required every three years or upon tenant turnover, whichever is less.

  • Landlords must disclose known information on lead-based paint hazards before the lease takes effect, and leases must include a disclosure form about lead-based paint.

 

  • Sellers must disclose known information on lead-based paint and hazards before selling a house. Sales contracts must include a disclosure form about lead-based paint. Buyers have up to 10 days to check for lead.

 

  •  Renovator’s are required to be EPA LEAD SAFE CERTIFIED FIRM to conduct Renovation, Repair and Painting (RRP) Rule.
